Terms & Conditions

It is the intention of Divine Vision Driving School to offer quality driving services that are safe and professional. It is important to note that these policies are meant to provide information on the conditions under which driving lessons are conducted. When booking a lesson or VORT test, the client agrees to abide by all the policies described herein.

Authority of the Instructor

  1. It should be noted that the instructor retains full and final control during the lessons and assessment.
  2. The instructor reserves the right to cancel, suspend, or refuse lessons at any time when:
    • The client is seen to be tired or ill, thereby unfit to drive.
    • The client is drunk or high.
    • The client exhibits behavior deemed unsafe, aggressive, and/or non-compliant.
    • There is any danger posed by the vehicle or external conditions.
  3. In the case of cancellation because of the issues described above, the cost of the entire lesson will be charged regardless.

Payment Policy

  1. The following policies apply in regard to lesson payments:
  2. Lesson fees must be paid before each lesson commences.
  3. Package fees must be fully paid during booking of the lesson.
  4. Payments must be made before booking is confirmed.

Cancellation & Rescheduling – Rules

  1. The client needs to notify of any cancellation or rebooking of a driving lesson at least 48 hours prior to the scheduled time.
  2. A notification of cancellation or change in appointment within 48 hours before the driving lesson will result in full payment of the lesson fees.
  3. In case of late cancellation or non-attendance, the fee shall be paid fully.
  4. If there is a late arrival on the part of the client, the lesson will still end on time and the full amount will remain payable.

Cancellation & Rescheduling – VORT

  1. Booking for VORT requires preparation and arrangement of proper timings.
  2. Cancellation or change in appointment within 5 days of the VORT will result in full payment of the test fees and car rental fee.
  3. The School does not guarantee another VORT date if the original booking is changed.
  4. Non-attendance at the allotted VORT time is considered a late cancellation and requires full payment of fees.

Client Responsibilities

  1. The Client should possess and produce a valid learner’s permit at all times during lessons and tests.
  2. It is the Client’s responsibility to obey all road laws and any other instructions given by the Instructor.
  3. The Client should always ensure they are physically and mentally capable of driving a car.
  4. During lessons, mobile phones must either be switched off or kept on silent mode unless prior approval is given by the Instructor.
  5. Any damage caused by reckless actions or deliberate sabotage will be billed to the Client.

Lesson Conditions

  1. Lessons shall start and end as scheduled whether the Client arrives late or not.
  2. The driving route is chosen by the Instructor based on the lesson objective, traffic conditions, and safety requirements.
  3. The structure of lessons may change from one session to another depending on the Client’s proficiency level.
  4. All lessons are conducted using a dual control car.

VORT Test Preparation and Suitability Assessment

  1. The Instructor reserves the right to assess whether the Client is adequately prepared to sit the VORT.
  2. If the Instructor determines that the Client is not sufficiently prepared or may pose a safety risk, the Instructor reserves the right not to book the test.
  3. This assessment decision is final and made in the interest of the safety of all road users.

VORT Assessors

  1. All VORT tests organised through Divine Vision Driving School are conducted by government-authorized Assessors (Examiners) appointed by the Government of South Australia.
  2. Examiners operate independently from the school and are bound by strict government guidelines, assessment criteria, and legal requirements.
  3. The Examiner’s decision is final and includes:
    • Whether the test was passed or failed
    • Assessment score
    • Safety assessment
    • Test cancellation
  4. Divine Vision Driving School cannot interfere with, overturn, or contest any Examiner’s decision.
  5. The Examiner’s test result decision is binding on the Client.

Weather, Traffic & Other Factors

  1. Lessons may be held in any weather except if conditions make it dangerous; the School retains the right to postpone lessons due to weather or other factors.
  2. In case of cancellation due to the weather, vehicle problems, or other unforeseen reasons, a new schedule will be made without an extra fee.
  3. The School will not be responsible for lessons affected by road closure, emergencies, or traffic situations that are out of their control.

Refund Policy

  1. The School does not offer refunds if a lesson or package has been fully completed.
  2. Prepaid lessons will be refunded according to the regular lesson price (without a discount).
  3. Lessons cancelled 48 hours before or VORT cancellations 5 days before receive no refunds.

Privacy & Confidentiality

  1. Any personal details supplied by the Client remain private and shall be used for booking and communicating only.
  2. Personal details are not shared with third parties except when it is legally necessary.

Liability

  1. Divine Vision Driving School will not be held responsible for any fines, violations or penalties the Client may incur before, during or after the lessons.
  2. Divine Vision Driving School will not be held responsible for any injuries, losses and damages that arise beyond its control.
  3. All lessons are delivered responsibly, however there is always some level of risk involved in driving which the Client voluntarily takes upon signing up

Acceptance

  1. When booking the lessons or accepting the terms and conditions, the Client automatically confirms them.

  • By booking or attending a lesson or VORT assessment with Divine Vision Driving School, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.

  2. 1.2 The student is under the influence of alcohol, drugs, or any impairing substance
  3. 1.3 Unsafe, aggressive, abusive, or disrespectful behaviour occurs
  4. 1.4 Road, traffic, weather, or vehicle conditions create a safety concern

VORT bookings involve preparation, scheduling, and vehicle allocation.

Any damage caused through reckless, negligent, or intentionally unsafe behaviour may become the responsibility of the student.

The Instructor reserves the right to determine whether a student is ready to undertake the VORT assessment.

If the Instructor believes the student is not adequately prepared or may present a safety risk, the VORT booking may be postponed or refused. This decision is made in the interest of road safety and is final.

8. VORT Assessors & Test Outcomes

All VORT assessments are conducted by government-authorised Assessors approved by the Government of South Australia.

Assessors operate independently and follow official government assessment standards and legal requirements.

The authorised Assessor has final authority regarding:

Divine Vision Driving School cannot influence, alter, or challenge the Assessor’s decision. All students must accept the final result issued by the authorised Assessor.

9. Weather & External Conditions

Lessons may continue in most weather conditions unless safety becomes a concern.

If Divine Vision Driving School cancels a lesson due to unsafe weather conditions, vehicle issues, or unavoidable circumstances, an alternative lesson time will be arranged at no additional cost.

Divine Vision Driving School is not responsible for delays, cancellations, or disruptions caused by traffic incidents, road closures, emergencies, or circumstances beyond our control.

The latest version of the Terms & Conditions will apply to all bookings and services.

By booking or attending lessons with Divine Vision Driving School, you confirm that you have read, understood, and agreed to these Terms & Conditions.
