Terms & Conditions
At Divine Vision Driving School, we are committed to providing safe, professional, and reliable driver training services. These Terms & Conditions explain how our driving lessons, VORT assessments, and related services operate.
- By booking or attending a lesson or VORT assessment with Divine Vision Driving School, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.
1. Instructor Authority & Safety
Safety is our highest priority at all times.
- The Instructor has full authority during all driving lessons and VORT assessments and may cancel, pause, or refuse a lesson if:
- The student appears unwell, fatigued, or otherwise unfit to drive
- The student is under the influence of alcohol, drugs, or any impairing substance
- Unsafe, aggressive, abusive, or disrespectful behaviour occurs
- Road, traffic, weather, or vehicle conditions create a safety concern
2. Payment Policy
- All lesson fees must be paid before the lesson begins
- Package bookings must be paid in full at the time of booking
- Driving lessons and VORT bookings are only confirmed once payment has been received
- Divine Vision Driving School is not responsible for unconfirmed bookings resulting from delayed or incomplete payment
3. Lesson Cancellations & Rescheduling
- A minimum of 48 hours’ notice is required to cancel or reschedule a driving lesson
- Cancellations made within 48 hours of the scheduled lesson time will incur the full lesson fee
- Failure to attend a lesson without prior notice will be treated as a no-show and charged in full
- If a student arrives late, the lesson will still finish at the scheduled time and the full lesson fee will apply
- Refunds or lesson credits are not provided for late cancellations or missed lessons
4. VORT Cancellations & Rescheduling
VORT bookings involve preparation, scheduling, and vehicle allocation.
- Any cancellation or rescheduling made within 5 days of the VORT booking date will incur the full VORT and car hire fees
- Failure to attend the VORT assessment at the agreed time will result in full fees being charged
- Alternate VORT dates cannot be guaranteed if the original booking is cancelled by the student
5. Student Responsibilities
Students are responsible for:
- Holding and carrying a valid learner’s permit during every lesson and assessment
- Following all road rules and Instructor directions
- Ensuring they are physically and mentally fit to drive
- Keeping mobile phones on silent unless otherwise permitted by the Instructor
Any damage caused through reckless, negligent, or intentionally unsafe behaviour may become the responsibility of the student.
6. Lesson Conditions
- Lessons start and finish at the scheduled booking time
- Lesson routes are selected by the Instructor based on training requirements, traffic, and safety conditions
- Lesson structure and training content may be adjusted depending on the student’s progress and driving ability
- All driving lessons are conducted in a dual-control vehicle for safety purposes
7. VORT Readiness
- The Instructor reserves the right to determine whether a student is ready to undertake the VORT assessment.
- If the Instructor believes the student is not adequately prepared or may present a safety risk, the VORT booking may be postponed or refused. This decision is made in the interest of road safety and is final.
8. VORT Assessors & Test Outcomes
All VORT assessments are conducted by government-authorised Assessors approved by the Government of South Australia.
Assessors operate independently and follow official government assessment standards and legal requirements.
The authorised Assessor has final authority regarding:
- Pass or fail outcomes
- Assessment scoring
- Safety decisions
- Test termination
Divine Vision Driving School cannot influence, alter, or challenge the Assessor’s decision. All students must accept the final result issued by the authorised Assessor.
9. Weather & External Conditions
- Lessons may continue in most weather conditions unless safety becomes a concern.
- If Divine Vision Driving School cancels a lesson due to unsafe weather conditions, vehicle issues, or unavoidable circumstances, an alternative lesson time will be arranged at no additional cost.
- Divine Vision Driving School is not responsible for delays, cancellations, or disruptions caused by traffic incidents, road closures, emergencies, or circumstances beyond our control.
10. Refund Policy
- Refunds are not available for lessons or services that have already been completed
- Unused prepaid lessons may be refunded based on the standard lesson rate rather than discounted package pricing
- No refunds will be provided for:
-> Late cancellations
-> Missed lessons
-> VORT cancellations made within the required notice period
11. Privacy Policy
All personal information provided by students is kept confidential and used only for:
- Bookings and scheduling
- Communication purposes
- Driver training services
- Personal information will not be shared with third parties unless required by law.
12. Liability
Divine Vision Driving School is not responsible for:
- Traffic fines or legal penalties received by the student
- Losses, damages, delays, or interruptions caused by circumstances outside our control
- Risks naturally associated with driving and road use
All training services are provided with reasonable care, professionalism, and attention to safety.
13. Changes to Terms & Conditions
- Divine Vision Driving School reserves the right to update, modify, or change these Terms & Conditions at any time without prior notice.
- The latest version of the Terms & Conditions will apply to all bookings and services.
14. Acknowledgement
- By booking or attending lessons with Divine Vision Driving School, you confirm that you have read, understood, and agreed to these Terms & Conditions.
